You or someone you know has been arrested. What happens now and what are your options? First, the accused is taken to a detention facility, whether county jail or local station lock up. Cash bail means the total amount of bail set is held by the courts until the trial is over. Cash bonds are usually set by the judge if the accused is a flight risk, has unpaid fines or has failed to appear in previous legal matters. The entire amount set by the judge is held as assurance the accused will appear at all scheduled court dates. The penalty for non-appearance is forfeiture of the cash and a bench warrant for his or her arrest.
Let is be understood that anyone can put up the cash bond for the accused. If the defendant puts up his or her own cash bond, any fines will be deducted before returning the balance to the accused.
